Karnataka High Court Stays Circulars Deferring Revised Minimum Wages for Contract Workers

In a significant legal development concerning labor rights, the Karnataka High Court has stayed administrative circulars issued by various state government departments that sought to defer the implementation of revised minimum wages for contract, daily wage, and outsourced employees. A single bench presided over by Justice H.T. Narendra Prasad issued the interim stay while hearing writ petitions filed by major trade unions, including the All India Trade Union Congress (AITUC) and the All India Central Council of Trade Unions (AICCTU). The dispute originates from an official notification issued by the Karnataka Labour Department on May 22, 2026, which revised the statutory minimum wage rates across 83 scheduled employments under the Minimum Wages Act, 1948. However, in July and August, departments such as Audit and Accounts, Municipal Administration, and Rural Development issued internal circulars directing authorities to withhold or suspend the enhanced wage payments. The petitioner unions challenged these circulars, contending that administrative departments possessed no legal authority or jurisdiction to override or suspend a statutorily notified wage revision. Taking note of the arguments, the High Court suspended the operation of the departmental circulars and issued formal notice to the state government.
