The new framework instructs legal counsel to move away from risk-averse approaches and instead provide practical, solutions-focused guidance that enables the government to execute public policies efficiently. Under the updated directives, a policy or administrative decision is considered unlawful only when no tenable legal argument exists to support it. Where a viable legal argument can be made—even if the risk of a successful court challenge remains high—the guidance confirms that it is constitutional and appropriate for ministers to proceed, provided they receive a full and transparent risk assessment. The initiative comes as Chancellor John Healey announced measures to eliminate excessive consultation delays and reduce bureaucratic friction across government departments. The guidance urges lawyers to proactively identify legislative options for reducing legal risk, ensuring that public administration remains agile and responsive while upholding statutory obligations and international law.
