Supreme Court Reserves Verdict on Packaged Food Warning Labels as FSSAI Proposes Red Hexagon System

The Supreme Court of India on Monday reserved its verdict regarding the timeline and regulatory framework proposed by the Food Safety and Standards Authority of India (FSSAI) for introducing front-of-pack warning labels (FoPL) on packaged food items. The top court observed that the transition timeline presented by the national food safety regulator appeared overly prolonged, stressing that public health and consumer nutrition literacy—particularly for growing children—remain matters of vital national importance. In its comprehensive affidavit submitted to the apex court, the FSSAI outlined a single-phase rollout mechanism under which packaged foods exceeding designated safety thresholds for added sugar, saturated fat, or salt must display a distinct red hexagonal warning symbol on the front left side of the packaging. Additionally, products containing non-caloric sweeteners will be required to carry explicit cautionary statements. The proposal has drawn sharp reactions from major industry groups, including the All India Food Processors Association, which represents leading domestic and global food brands. In court filings, industry representatives urged a review of the red color code, arguing that Indian consumers already associate red and green dots with non-vegetarian and vegetarian food classifications, which could lead to widespread confusion. However, public health advocates and medical professionals have strongly backed the immediate implementation of red warning symbols to combat rising rates of lifestyle diseases, diabetes, and childhood obesity across the nation. The Supreme Court confirmed it will pass orders balancing administrative feasibility with public interest.
